Witnesses to the Criminal Criminal Case in Haltim admit the activity was carried out on PT WKM’s land

VIRALTERKINI.ID, JAKARTA – Criminal cases of illegal stakes that involved two employees of PT Wana Kencana Mineral (WKM), Awwab Hafidz and Marsel Bambang, were again held at the Central Jakarta District Court, Wednesday (10/9) yesterday. This time, the hearing presented PT Position Operational Director, Hari Aryanto Dharmaputra, as a witness before the panel of judges led by Judge Sunoto.

During the trial, Hakim Sunoto then asked about the cooperation agreement between PT Position and PT WKS (Wana Kencana Sejati), namely PKS No.1 WKS POS 2024 dated February 12, 2004 along with its Admissions. Aryanto also answered that the cooperation contained was only limited to the construction and maintenance of the road.

“The question is, the agreement gives the right to PT Position to carry out mining or only the use of transportation roads?” Judge Sunoto asked witnesses in the trial.

“So only construction and upgrading the road because it will be used by both parties. Only for the use of the road,” Aryanto told the Panel of Judges.

However, when the judge mentioned the Minutes of Meeting (Mom) dated February 13, 2025 which showed the activity of PT Position in the IUP area owned by PT WKM, Aryanto did not argue. Aryanto remained adamant his company’s activities referring to cooperation with PT WKS.

“We are doing activities at PT WKM because in accordance with our cooperation (with PT WKS). We recognize the law that justifies PT WKM,” explained Aryanto.

No doubt, PT WKM’s attorney, Otto Cornelis Kaligis (OC Kaligis) finally accused Aryanto’s testimony with a thick narrative. He considers the statement of PT Position witnesses not to have a strong foundation.

OC Kaligis also emphasized that PT Position did not have an IUP at the case location. Because referring to the decision of the Governor of North Maluku, PT WKM is the legal owner of the land area.

“Our clients peg in the IUP area owned by PT Wana Kencana Mineral itself, where they work,” he said.

Moreover, said OC, PT Position has also recognized to carry out land clearing in the PT WKM IUP area through Mom documents dated February 13, 2025. (MJ)
