The trial of the Mine Stock Dispute case presents the Head of the Ambon XIC Lestari Forest Management Center (BPHL)

VIRALTERKINI.ID, JAKARTA-The 7th Advanced Session in the Mine Stock Dispute Between PT Position and PT Wana Kencana Mineral (WKM), Wednesday (1/10/2025) around 17.00 WIB at the Central Jakarta District Court.

The agenda of the trial is listening and presenting witnesses from the Head of the Ambon Ambon XIC Lestari Forest Management Center (BPHL), Plaghelmo Seran.

In the trial, the Chief Judge Sunoto questioned the Plaghelmo statement regarding the activity of PT Position in the Mining Business Permit (IUP) WKM. The judge highlighted the construction of the road carried out in the area.

“Making a logging road in the PBPH area that crosses the mining business license area does not have to get permission from the IUP holder that is crossed. It seems that you say that the position if you want to make logging so you don’t need to ask for permission from WKM, so the point is this statement? Is it true or not?” Judge Sunoto said at the Central Jakarta District Court, Wednesday (1/10/2025).

“It can be interpreted so,” replied Plaghelmo.

The judge reiterated, by referring witness statements in the Minutes of Examination (BAP), that PT Position did not need a WKM permit to build a logging road.

“It means that the conclusion is that this your sentence is a position, you don’t need permission to the time, right?” the judge asked.

However, the judge then alluded to the change in the logging road to the hauling road. He questioned whether the change in function requires approval from the WKM as the holder of the IUP that is crossed.

“My question is like this, but in this case what happens is upgraded from the logging road to a mining hauling road. Does the change in the function of this road do not require the approval of the WKM as the IUP holder whose territory is crossed?” Judge scratched.

“Don’t know,” said Plaghelmo.

The answer provoked the ambition of the Assembly. Judge Sunoto was surprised that the witness could answer the previous licensing matter, but claimed not to know when asked about the hauling activities of PT Position.

“How come you can answer earlier, so can you answer?” Judge scratched.

“If it is a boundary issue, it is not (permission to hold IUP), but if the use of the road …” said Plaghelmo who was then deducted by judges.

“This witness sometimes when the trial looks like this. My question is easy. Okay, I continue this so that the PH doesn’t need to ask a lot,” said the judge.

This case dragged two employees of PT WKM, Awwab Hafidz and Marsel Biaalembang, as defendants. Both were reported by PT Position to the Criminal Investigation Police regarding the alleged installation of illegal stakes in the East Halmahera mine.

However, the attorney assessed that the report was not appropriate. They mentioned the act of installing a stake carried out in an area that is part of the PT WKM mining concession itself.

In this trial there were several parties who attended and monitored the trial, namely the North Maluku activist association who always participated in the trial of this case which was initiated by Yohannes Masudede, SH, MH as the coordinator of the North Maluku Activist Association.
