Viralterkini.idPADANG — The Supreme Court (MA) encourages all regional governments (Pemda) in Indonesia to be more responsive in socializing the new Criminal Code (KUHP) and Criminal Procedure Code (KUHAP) to the public.
“The regional government must socialize the new Criminal Code and Criminal Procedure Code to the community,” said Prim Haryadi when giving a statement in Padang, Saturday.
Prim explained that the provincial and district/city governments actually have adequate equipment to carry out the socialization function, such as the existence of law firms or legal departments in each region. By utilizing this instrument optimally, it is hoped that the public can gain a comprehensive understanding of the new regulations.
Apart from that, regional governments are also advised to collaborate with universities in the education process. This effort is considered to be more effective if it involves law enforcement officials, from the police, prosecutor’s office, to the courts.
Prim, who also serves as General Chair of the Central Leadership Council (DPP) of the Alumni Family Association of the Faculty of Law, Andalas University, emphasized that there are three important regulations that must be widely disseminated to the public. The three are Law Number 1 of 2023 concerning the Criminal Code, Law Number 20 of 2025 concerning the Criminal Procedure Code, and Law Number 1 of 2026 concerning Criminal Adjustments.
According to him, understanding these three rules is very crucial to avoid differences in perception in their application in the field.
He gave an example, in the new Criminal Code it is emphasized that imprisonment is the last step or last resort. This means that, if possible, lighter sentences such as social work, fines, supervision or probation should be preferred over imprisonment.
However, Prim believes that there are still many people who do not fully understand the punishment system in the latest Criminal Code. Therefore, in the current transition period, the Supreme Court emphasizes that socialization of the Criminal Code, Criminal Procedure Code and criminal adjustments must continue to be intensified.
On the other hand, he said that socialization among law enforcement officers had gone quite well so far. However, education at the grassroots level still needs to be expanded and strengthened so that the public obtains an up-to-date understanding of the law enforcement system in Indonesia. (ma)
